Welcome to the Cargobull beUpToDate-App, an offer from Schmitz Cargobull AG. With the beUpToDate-App, you can use your smartphone to conveniently access the most important vehicle information for your fleet while on the move. These include in particular vehicle status (e.g. position, temperatures, coupling), geographical location and message information. The required data is obtained directly from the TrailerConnect telematics portal, so that you can also use your already known login data. When using this app, personal data is also processed. The protection of your personal data as well as fair and transparent data processing is important to us. In the following, we would like to provide you with the information you need to check and exercise your data protection rights.

3. Personal Data

The concept of personal data is defined in the General Data Protection Regulation (hereinafter "GDPR"). Personal data means any information relating to an identified or identifiable natural person. This includes, for example, your civil name, your address, your telephone number or your date of birth. Information about your usage behaviour of this app can also be personal data if it allows conclusions to be drawn to your person.


4. Which Data Do We Process for Which Purposes?

We process personal data when you instal and use the app. We have listed which personal data is processed for you in the following:

4.1 Data That is Collected During Download

When you download the app, certain necessary information will be transmitted to the app Store you select (e.g. Google Play or Apple App Store), including but not limited to your username, email address, customer number of your account, time of download, payment information, and unique device identification number. These data is processed exclusively by the respective App Store and are outside our sphere of influence. This data processing is justified by the fact that the processing is necessary for the performance of the contract between you and us pursuant to Art. 6 para. 1 lit. b GDPR for the use of the app.

4.2 Data Required for the Provision and Use of the App

As part of your use of the app, we automatically collect certain data necessary for the use and security of the app (Art. 6 para. 1 lit f GDPR). This includes Time of access, IP address, and location to connect to the data servers.


5. Use of Google Firebase

In order to continuously improve and optimize our services, we use so-called tracking technologies from Google Firebase (Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland).

Google Firebase allows the analysis of the use of our services. Google will use this information to evaluate the use of our app and to provide us with other services associated with the use of apps. Google Firebase uses identifiers for mobile devices. This involves the use of cookie-like technologies, unique device identification for advertising (Android advertising ID or Advertising Identifier for iOS) and user data.

In this way, information about the use of our app is collected and transferred to Google in the USA and stored there. Google has obtained Privacy Shield certification to comply with the EU-US Privacy Shield Agreement published by the U.S. Department of Commerce on the collection, use, and storage of personal information from EU member states.

6. Will My Data Be Transmitted to Third Parties?

In order for Schmitz Cargobull to be able to process your data in accordance with the purposes described above, it may be necessary for other recipients to be able to view and process your data.

6.1 Recipients Within the Schmitz Cargobull Group

In special cases it may be necessary for us to process your data group-wide. However, data processing within the Schmitz Cargobull Group will only take place if we have legal permission to do so.

This is the case, for example, if other companies of the Schmitz Cargobull Group process data on behalf of us or if there is a legitimate interest pursuant to Art. 6 para. 1 f GDPR. Our legitimate interest are internal administrative purposes including the customer service as far as it is necessary.

6.2 External Service Providers (Contract Processors)

Your data will be passed on to service partners if they work on our behalf and support Schmitz Cargobull in the provision of their services. If, for example, you use this app, we have commissioned a service provider with maintenance and hosting. Your personal data will be processed by commissioned service providers as part of order processing in accordance with Art. 28 GDPR.

6.3 Other Service Providers, Partners and Third Parties

Schmitz Cargobull may cooperate with other partners if it is necessary to fulfil our service offers or if we are legally obliged to disclose data. We attach great importance to processing your data within the EU. However, it may happen that we use service providers who operate outside the EU. In such cases, we ensure that an adequate level of data protection is established prior to the transfer of your personal data. This means that standard EU contractual clauses or an adequacy decision, such as the EU-US Privacy Shield, will achieve a level of data protection comparable to standards within the EU.


7. How Long Will My Data Be Kept?

We delete personal data of the data subject as soon as the purpose of the storage no longer applies and statutory retention periods do not prevent deletion.


8. What Rights Do I Have and How Can I Assert Them?

You have the following rights against us with regard to your personal data:

8.1 General Rights

You have the right of access, rectification, erasure, restriction of processing, object to processing and portability of data. If a processing is based on your consent, you have the right to withdraw your consent with effect for the future.

8.2 Data Processing Rights According to Legitimate Interest

Pursuant to Art. 21 (1) GDPR, you have the right, for reasons arising from your particular situation, to object at any time to the processing of your personal data on the basis of Art. 6 (1) e GDPR (data processing in the public interest) or Article 6 (1) f GDPR (data processing to safeguard a legitimate interest). This also applies to profiling based on this provision. In the event of your objection, we will no longer process your personal data unless we can prove compelling reasons for the processing worthy of protection which outweigh your interests, rights and freedoms, or the processing serves the assertion, exercise or defence of legal claims.

8.3 Rights in Direct Advertising

If we process your personal data for the purpose of direct advertising, you have the right, pursuant to Art. 21 para. 2 GDPR, to object at any time to the processing of your personal data for the purpose of such advertising; this also applies to profiling insofar as it is connected with such direct advertising. In the event of your objection to processing for the purpose of direct marketing, we will no longer process your personal data for these purposes.

8.4 Right to Complain to a Supervisory Authority

You also have the right to complain to a competent data protection supervisory authority about the processing of your personal data by us.
